ELECTRONIC FUND TRANSFERS
YOUR RIGHTS AND RESPONSIBILITIES
ATM Services
This Agreement sets forth the ATM card terms and conditions
relating to the use of your Rolette State Bank Card at automated teller
machines (ATMs) and other electronic banking services (EFT). Rolette State
Bank will hereinafter be referred to as (we) (us) or Rolette State Bank.
I. Services Available at Automated Teller Machines
and Other Electronic Funds Transfers.
A. Withdraw cash from your checking or savings
account. (ATM)
B. Transfer fund(s) between your checking or savings
account. (ATM)
C. Obtain account balance information. (NOTE:
The balance figure may not reflect recent transactions, and may include
funds which are not subject to immediate withdrawal.) (ATM)
Some of these services may not be available at all ATMs.
These particular transactions are not covered by
the error resolution or liability section of this Agreement.
II. Limitations on Dollar Amounts of Transfers.
You may withdraw up to $200 in cash from ATMs per 24-hour period. Additional
limitations may exist for ATMs operated by other institutions. You cannot
make payments, deposits or transfers at ATMs other than at your own financial
institution.
III. Charges. There are fees associated with the
use of non-proprietary ATMs. There will be a $l.00 charge for each use
of a non-proprietory ATM. Entries initiated through the ATMs subsequently
posted to your checking account are subject to the bank service charges
just as if you had actually written a check.
IV. How to Notify Us of an Unauthorized Transaction.
If you believe your card or personal Identification Number (PIN) has been
lost or stolen or that someone has transferred or may transfer money from
your account without your permission, contact us:

V. Business Days. Our business days are Monday
through Friday, unless otherwise posted. Holidays are not included. (NOTE:
Transfers made at ATMs on a non-business day or after the ATMs processing
cut off time will be posted on the next business day.)
VI. Your liability. Tell us AT ONCE if you believe
your Card or PIN has been stolen. Telephoning is the best way of keeping
your possible losses to a minimum. You could lose all the money in your
account. If you tell us within two business days, you can lose no more
than $50 if someone used your Card or PIN without your permission.
If you do NOT tell us within two business days after you
learn of the loss of your Card or PIN and we can prove that we could have
stopped someone from using your Card or PIN without your permission if
you had told us, you could lose as much as $500.
Also, if your statement shows transactions that you did
not make, tell us at once. If you do not tell us within 60 days after
the statement was mailed to you, you may not get back any money you lost
after the 60 days if we can prove that we could have stopped someone from
taking the money if you had told us in time.
If a good reason (such as a long trip or a hospital stay)
kept you from telling us, we will extend the time periods.
VII. Bank Liability: If we do not complete a transaction
to or from your checking or savings account on time or in the correct
amount according to this Agreement with you, we will be liable for your
losses or damages. We will not be liable, however, if:
A. Through no fault of ours, your account does
not contain sufficient available funds to make the transfer.
B. The ATM where you are making the transactions
does not have enough cash.
C. The ATM was not working properly and you knew
about the breakdown when you started the transaction.
D. Circumstances beyond our control (such as
fire, flood, or mechanical or electrical failure) prevent the transaction
and we have taken responsible precautions to avoid those circumstances.
E. The money in your account is subject to legal
process or any other encumbrance restricting transfers.
F. There is an error on your account due to a
card not issued by our institution.
G. There may be other exceptions not specifically
mentioned above.
VIII. Documentation. You will get a receipt at
the time you perform a transaction at an electronic terminal. You will
also get a monthly account statement unless there are not transactions
on a particular month. This section does not apply to transactions occurring
outside the United States.
IX. Privacy. We may disclose information to third
parties about your accounts and the transactions you perform:
A. Where it is necessary or helpful for completing
transactions.
B. To comply with the law or with a Government
agency or Court Order.
C. To verify the existence and condition of your
account for a third party, such as a credit bureau, merchant, another
Rolette State Bank or CIRRUS member, and then the information disclosed
pertains only to your payment habits in connection with loans and other
credit accommodations and does not include information concerning balances
in savings or checking accounts.
D. If your give us your written permission.
E. When disclosure is made to the holder of a
negotiable instrument drawn on the bank as to whether you have sufficient
funds in the bank to cover the instrument.
X. Change in Terms. We may change the terms of
the Agreement from time to time by sending a written notice or amended
Agreement to you at the last address shown in our records for your EFT
account. We reserve the right to terminate the Agreement and/or your use
of ATMs and other EFTs with or without cause. We may immediately do so
if:
A. You or any authorized use of your Card breaches
an other agreement with us;
B. We have reason to believe that there has been or may be an
unauthorized use of your Card or PIN;
C. You or any authorized user of our Card(s) or Card account(s)
request that we do so.
NOTE: If you ask us to terminate or suspend your account
or the use of any account cards at ATMs or other EFTs, you will remain
liable for subsequent ATM and EFT transactions performed by any other
party to your ATM Card, EFT account.
Your Card(s) are the property of Rolette State Bank. You
agree to surrender all Card(s) to us upon request.
Except as stated otherwise in this Agreement, this Agreement
does not alter or amend the terms or conditions of any account agreement
you have with us.
XI. Severability. If an part of this Agreement
is found to be unenforceable, the remaining portions of the Agreement
shall remain in full force and effect.
NOTICE:
Security. You agree not to disclose or otherwise make your Card or PIN
available to anyone without prior written consent. For security reasons,
we ask that you not write your PIN on your Card or keep it in the same
location as your Card.
